This privacy policy applies to data processing by:

§2. Duration of storage and processing of personal data as well as type and purpose of their use

Customer account creation and ordering

Setting up a customer account

You can set up a password-protected customer account with us, in which we store your personal data. This serves to enable you to process your orders with the greatest possible user-friendliness through a simple purchase process.

When opening a customer account, the following personal data is collected, processed and used by the contractual partner named under paragraph 1:

 

  • E-mail address,
  • First and Last Name,
  • possibly company name
  • Your address (for sending the goods, invoicing and, if necessary, receiving information mail),
  • Your telephone number (to arrange delivery dates with you if necessary),
  • The option to sign up for future newsletters or customer information

 

To create a user account, you must also provide a password, which you create yourself. In combination with your e-mail address, this enables access to your user account. There you can view and change the data stored about you at any time.

 

The legal basis for the processing of your personal data when opening a customer account is: Article 6 (1) sentence 1 lit. b GDPR, fulfillment of the contract for the use of the services of the contractual partner named in paragraph 1 via the web shop www.turfcom. de, and if applicable your consent Art. 6 Para. 1 S. 1 lit. a GDPR.

Ordering  via the customer account

 

If you would like to order products via your customer account via our website: www.turfcom.de, we collect the following information:

  • salutation, first name, last name,
  • a valid email address,
  • possibly company name
  • address,
  • date of birth,
  • phone number,

    Payment data, depending on the selected payment method (e.g. credit card data or Paypal account data).

This data is collected

  • To identify you as our contractual partner;
  • to check your age and to check the entered data for plausibility;
  • to process the payment of your order;
  • in order to be able to answer questions about the order more quickly by telephone;
  • to process any warranty claims that may exist and to assert any claims against you.

In order to ensure efficient processing of your order, you can also voluntarily provide further data:

  • an alternative delivery address.

The data processing takes place at your request and is necessary according to Art. 6 Para. 1 S. 1 lit.

 

Newsletter

A newsletter is sent exclusively on the basis of your consent in accordance with Article 6 (1) sentence 1 lit. a GDPR.

Data transfer to third parties

To carry out the order processing, service providers commissioned by us (e.g. transport companies, logisticians, banks) receive the necessary data for order and order processing in order to fulfil the order. As part of financial accounting, customer order and address data are sent to the responsible tax office and as part of the recurring tax audit to the responsible tax office of the contractual partner. Your data will be passed on to third parties on the basis of Article 6 (1) sentence 1 lit. b GDPR and only to the extent that this is legally permissible and necessary for the processing of contractual relationships with you.

The data passed on in this way may only be used by our service providers to fulfil  their task. Any other use of the information is not permitted.

Your personal data stored by us will be completely deleted after the purpose of use has ceased to exist, unless we are required to do so in accordance with Article 6 Paragraph 1 S. 1 lit. c DSGVO due to tax and commercial law storage and documentation obligations (from HGB, StGB or AO ) are obliged to store data for a longer period of time or you have consented to further storage in accordance with Article 6 Paragraph 1 Clause 1 Letter a GDPR. Furthermore, the general storage period of your personal data can be up to 30 years in exceptional cases, insofar as this is necessary to assert, exercise or defend legal claims.

  1. Customer Rights

As a customer, you have the right:

  • pursuant to Art. 7 Para. 3 GDPR, to revoke the consent you have given to us at any time. As a result, we are no longer allowed to continue the data processing based on this consent for the future;
  • to request information about your personal data processed by us in accordance with Art. 15 GDPR. In particular, you can obtain information about the processing purposes, the category of personal data, the categories of recipients to whom your data was or will be disclosed, the planned storage period, the existence of a right to correction, deletion, restriction of processing or objection, the existence of a Right of appeal, request the origin of your data if it was not collected from us;
  • in accordance with Art. 16 GDPR, to immediately request the correction of incorrect or incomplete personal data stored by us;
  • According to Art. 17 GDPR, to request the deletion of your personal data stored by us, unless the processing is necessary to exercise the right to freedom of expression and information, to fulfill a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims is required;
  • pursuant to Art. 18 GDPR, to request the restriction of the processing of your personal data if you dispute the accuracy of the data, the processing is unlawful but you refuse to delete it; we no longer need the data, but you need them to assert, exercise or defend legal claims or you have lodged an objection to the processing in accordance with Art. 21 GDPR;
  • in accordance with Art. 20 GDPR, to receive your personal data that you have provided to us in a structured, common and machine-readable format or to request transmission to another person responsible;
  • to complain to a supervisory authority in accordance with Art. 77 GDPR. As a rule, you can contact the supervisory authority of your usual place of residence or work or our company headquarters.

 

§4. Right to object

If your personal data is processed on the basis of legitimate interests in accordance with Article 6 Paragraph 1 Clause 1 Letter f GDPR, you have the right to object to the processing of your personal data in accordance with Article 21 GDPR, provided that there are reasons for this, which arise from your particular situation or the objection is directed against direct advertising. In the latter case, you have a general right to object, which we will implement without specifying a particular situation.

§6. Matomo for analysis

 

This website uses Matomo, an open source software (formerly PIWIK) for the statistical evaluation of visitor access. NO cookies are used or stored for this purpose. Your IP address is immediately anonymized during this process, so that you as a user remain anonymous to us. The information generated by Matomo about the use of the website is not passed on to third parties.

 

Matomo is (in contrast to e.g. Google Analytics) installed on our own server. The server on which the statistical data is stored is from a German provider and is physically located in the EU.

 

We support the so-called "Do-Not-Track" settings in your browser so that you can refuse this tracking.

 

The processing of data takes place on the legal basis of Article 6 Paragraph 1 Subparagraph 1 Letter a) GDPR. Otherwise, it is based on Article 6 Paragraph 1 Subparagraph 1 Letter f) GDPR. Our legitimate interest lies in optimizing our website, improving our offers and online marketing.
